Determining the Most Beneficial Venue

Gordon personally takes time to determine which state’s laws and venue may be most favorable for your case. In his view, California is among the better venues in the country for people harmed by toxic substances. In most instances, Gordon has been successful in bringing cases involving out of state clients to the most favorable venues within California.

A retired shipyard worker living in Nevada filed in San Francisco, went to trial in eight months, and only had to be present three days. His testimony was strong enough that the remaining defendants did not want the case to go to the jury. After he died, his sons kept receiving settlements from the asbestos trusts.

An Oregon family with a mesothelioma diagnosis had a wrongful-death case filed in San Francisco within a month. Court settlements and trust settlements both continued.

Gordon’s history with Asbestos

In the late 1970s through the 1980s, few individual law firms had the resources to pursue large toxic tort cases. Gordon developed litigation projects that brought established law firms together to share the substantial time, expense, and responsibility required. By 1984, he supervised and coordinated more than 24 firms representing over 30,000 individual plaintiffs in multiple jurisdictions from coast to coast, including the Republic of the Marshall Islands.

1977–1994: Long Beach, Mare Island, and Hunters Point

We filed individual asbestos cases for more than 4,000 current and retired workers at the Long Beach, Mare Island, and Hunters Point Naval Shipyards. Most of those clients were in the trades — boilermakers, riggers, laggers, electricians, pipefitters — men who had built the ships and been kept in the dark about the dangers of the dust well into the 1980s.

By the time Johns-Manville, the largest asbestos manufacturer, filed for Chapter 13 bankruptcy protection on August 2, 1982, my firm represented 25% of all asbestos cases filed in the United States against it. I served on the Asbestos Health Claimants Committee in those New York proceedings and in other asbestos-company bankruptcies that followed. Those cases led to the asbestos trust funds still used today.

1985–1992: National Tire Workers Litigation Project

In 1985, while testing workers for chemical exposures from the closed Firestone factory that had been disposing of its waste at the Crazy Horse landfill, we found an epidemic of asbestos-related illness among American tire-manufacturing workers. Despite resistance from the tire and asbestos industries, the project represented more than 13,000 tire workers, coast to coast, exposed to asbestos.

Industrial talc used in abundance in those factories was found to contain up to 60% tremolite asbestos. This was vehemently disputed by talc manufacturers. Today, that hazard is widely accepted.
